Booking terms

Bella Volto Photo is the portrait photography business of Amy Nichole Harbison, based in Rock Island, Tennessee, serving Nashville and Middle Tennessee. These terms apply to every session you book with us. Booking a session and paying the retainer means you have read and agree to them. If anything here is unclear, email amy@bellavoltophoto.com before you book.

1. Booking and retainer

  • To book, email Amy. There is no online checkout. Once we confirm your date, time and location, Amy emails you an invoice for the retainer.
  • A $75 non-refundable retainer reserves your date and time. It is applied to your session fee. You can transfer it to a new date once if you reschedule under section 4.
  • Your date is not reserved until the retainer is paid. Unpaid retainer invoices expire after 3 days, and the date is released.
  • Prices on our Pricing page are "starting at" prices. Your invoice shows your final session fee and any agreed extras (additional people at $30 each, additional retouched images at $30 each, travel or location permit fees, hair and make-up, rush editing). Travel and permit fees are always agreed before booking.

2. Balance due

The remaining balance is due on or before your session day. If the balance has not been paid by the start of the session, we may postpone the session. Galleries are delivered after payment in full.

3. Payment methods

We accept payment through PayPal at paypal.me/adventureourlife, using the invoice Amy sends you. Please pay as "Goods and Services", not "Friends and Family", so your payment carries PayPal's purchase protection. Other methods, such as cash or Venmo, only if Amy agrees in writing.

4. Rescheduling (weather, illness, life)

  • Weather: For outdoor sessions, Amy watches the forecast and will contact you if rain, extreme heat or cold, or unsafe conditions are likely. We'll pick a new date together at no charge, and your retainer moves with you.
  • Illness or emergency: If you, your child or another person in the session is sick, please tell us as soon as you can. We will reschedule at no charge. Please don't come to a session sick.
  • Other reasons: You may reschedule once with at least 48 hours' notice, and your retainer transfers. Further reschedules, or reschedules with less notice, need a new retainer.
  • Rescheduled sessions should take place within 90 days of the original date.

5. Cancellations and refunds

  • If you cancel: The $75 retainer is non-refundable. Anything you have paid above the retainer is refunded, minus non-refundable costs already paid to third parties for your session (such as location permits, props or hair and make-up), which we will show you.
  • No-shows: If you don't arrive and haven't contacted us within 30 minutes of the start time, the session is treated as cancelled by you.
  • If we cancel: If Bella Volto Photo cancels and cannot reschedule on a date that works for you, you receive a full refund of everything you paid, including the retainer.
  • Refunds go back through PayPal within 10 business days.

6. Late arrival

Please arrive on time. Your session ends at its scheduled time so the next client isn't affected, and the session fee is not reduced if you arrive late. If you're running late, text or email us. If you are more than 30 minutes late without contacting us, we may treat it as a no-show.

7. Delivery and gallery

  • Your retouched images are delivered in a private online gallery within 3 weeks of your session (fine art and styled sessions up to 5 weeks). Rush editing is available for an added fee.
  • Galleries stay online for 14 days. Please download and back up your images right away. Reopening a gallery for another 7 days costs $50.
  • After the gallery closes, we keep archive copies as a courtesy for 90 days, but we can't guarantee to keep files after that.
  • Amy selects and edits the images that best fit the artistic style of the session. Unedited or RAW files are not provided.
  • Prints, metal prints, canvases and albums are quoted after your session.

8. Image rights and your license

  • Under U.S. copyright law (17 U.S.C. §§ 102, 106 and 201), Amy Nichole Harbison / Bella Volto Photo owns the copyright in every photograph, including the images delivered to you.
  • Once you have paid in full, you receive a personal-use license to: print the images for yourself, share them on your personal social media (please tag @bella_volto_photo), and give copies to family and friends for personal use.
  • Without written permission, you may not: sell the images, use them in advertising or for commercial purposes (unless you purchased a headshot or commercial session that includes that use), enter them in contests, remove the watermark or credit, or alter them by applying filters, heavy edits or AI tools.
  • For headshots and commercial work, the license for professional or business use is set out in your invoice or quote.

9. Model releases, portfolio use and minors

  • Amy would love to share her work, but we never use your likeness or your child's in our portfolio, website, social media or advertising without a signed model release. Tennessee's Personal Rights Protection Act, as updated by the ELVIS Act of 2024 (Tenn. Code Ann. § 47-25-1101 et seq.), protects your name, photograph, likeness and voice from unauthorized commercial use, and we follow it.
  • Signing a release is optional and isn't required to book. You can choose which uses you agree to, and you can withdraw the release for future uses at any time by emailing us. (Materials already printed or published can't always be withdrawn.)
  • For anyone under 18, a parent or legal guardian must sign the release. A parent or guardian must also be at every session involving a minor.

10. Conduct and safety at locations

  • Please follow the photographer's directions at locations. Stay off railroad tracks, private property without permission, cliff edges and fast water. Many local spots, including state parks, have their own rules and may require permits.
  • You are responsible for supervising your children and pets, and for any damage caused by your party.
  • Amy may pause or end a session if conditions become unsafe or if anyone is abusive or harassing. If that happens because of the client's party, the session counts as completed. If it's for reasons outside your control, we'll reschedule.
  • You take part in outdoor sessions at your own risk of ordinary outdoor hazards such as uneven ground, insects and weather, to the extent Tennessee law allows.

11. Limitation of liability

We take great care with your images. We use professional equipment, backup memory cards and file backups. Still, equipment can fail, files can be corrupted or lost, and things can go wrong. If we cannot deliver some or all of your images for reasons within our control, our total liability is limited to a refund of the amounts you paid for that session, or a free reshoot if you prefer. We are not liable for indirect or consequential losses. Nothing in these terms limits liability that can't be limited under Tennessee law, including liability for gross negligence or willful misconduct.

12. Force majeure

Neither of us is responsible for delays or cancellations caused by events beyond reasonable control, such as severe weather, natural disasters, fire, flood, power or internet outages, illness or injury, public health orders or road closures. If such an event happens, we will try to reschedule first. If we can't agree on a new date within 90 days, you will be refunded everything you paid except the retainer, or the full amount, including the retainer, if the cancellation was on our side.

13. Privacy

We use your information only to plan your session and deliver your images. See our Privacy page.

14. Clear terms and governing law

We want these terms to be clear and fair, consistent with the Tennessee Consumer Protection Act (Tenn. Code Ann. § 47-18-101 et seq.). These terms are governed by Tennessee law. Any dispute will be handled in the state courts of the county in Tennessee where Bella Volto Photo is located Warren County, and small claims may be brought in General Sessions Court. If any part of these terms is found unenforceable, the rest still applies. If your invoice includes a written agreement that differs from these terms, the invoice controls.
